1. Acceptance of terms
By creating a Clario account or using our USSD service, you agree to these Terms of Service. If you do not agree, do not use Clario.
2. What Clario does
Clario provides an escrow service. When a buyer creates a deal, their payment is processed and protected through our licensed payment partner’s regulated infrastructure. It is not paid directly to the seller until the buyer confirms the goods or services were delivered as agreed. Clario determines when a payment is released based on deal status and dispute outcomes, but does not itself custody customer funds outside of that regulated infrastructure. Clario is not a party to the underlying sale between buyer and seller, and does not guarantee the quality, legality, or description of any item or service exchanged through a deal.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use Clario. You are responsible for the accuracy of the information you provide when registering.
4. Deals, fees, and escrow
- A buyer pays the agreed amount plus a buyer fee; the seller receives the agreed amount minus a seller fee. Current fee percentages are shown before you confirm a deal.
- Funds are held in escrow from payment confirmation until the buyer confirms delivery, at which point they are released to the seller’s verified payout account.
- Releasing funds requires your transaction PIN. Repeated incorrect PIN attempts will temporarily lock confirmation on that deal as a security measure.
5. Disputes
If a buyer believes a deal was not fulfilled as agreed, they may raise a dispute instead of confirming delivery. Clario will review the evidence provided by both parties and resolve the dispute by either releasing funds to the seller or refunding the buyer. Clario’s decision on a dispute is final.
6. Account suspension
We may suspend or ban an account that we reasonably believe is being used fraudulently, abusively, or in violation of these terms, including pausing that user’s ability to log in or create new deals. Deals already in progress at the time of suspension are handled case-by-case to protect the counterparty’s funds.
7. Prohibited use
- Using Clario for illegal goods, services, or money laundering.
- Creating deals with no genuine underlying transaction.
- Attempting to circumvent, disable, or abuse dispute resolution.
- Sharing your password or transaction PIN with anyone else.
8. Limitation of liability
Clario provides the escrow service on an “as is” basis. To the fullest extent permitted by law, Clario is not liable for indirect or consequential losses arising from your use of the platform, including losses arising from a counterparty’s conduct outside Clario’s control.
9. Changes to these terms
We may update these terms from time to time. Continued use of Clario after changes take effect constitutes acceptance of the updated terms.
